Buffalo Social Host Ordinance

Social host refers to adults who knowingly or unknowingly host underage drinking parties on their property. A social host liability ordinance will hold adults responsible for these underage drinking parties.

  • Eight of ten (81%) Johnson County residents say underage drinking is a serious problem. (a)
     

  • Nearly all (96.5%) of Johnson County residents agree that local law enforcement should strongly enforce laws regulating youth alcohol use. (a)
     

  • Nine of ten (91%) Johnson County residents agree that adults who supply alcohol to youth should be prosecuted. (a)
     

  • Underage drinking increases the risk of physical and sexual assault, academic failure, illicit drug use, alcohol dependence, and suicide attempts. (d)
     

  • Seven of ten (66%) high school seniors reported being at a gathering where large amounts of alcohol were available. (b)
     

  • Seven of ten (72%) 6th through 12th grade students obtained their last drink of alcohol from a parent, a friend’s parent, or other adult over 21. (b)

    ORDINANCE NO. 1321

    AN ORDINANCE CREATING CHAPTER 16, SECTION 16-42 OF THE CODE OF THE CITY OF BUFFALO, WYOMING, PERTAINING REGULATIONS CONCERNING SOCIAL HOSTS OF UNDERAGE ALCOHOL PARTIES.

                WHEREAS, the City finds it necessary to create Chapter 16, Section 16-42 of the Code of the Town of the City of Buffalo.

                NOW, THEREFORE, be it ordained by the governing body of the Town of the City of Buffalo, Wyoming, as follows:

    SECTION ONE:  Chapter 16, Section 16-42 of the Code of the City of Buffalo is hereby created to read, in its entirety, as follows:

    SEC. 16-42. REGULATIONS CONCERNING SOCIAL HOSTS OF UNDERAGE ALCOHOL PARTIES.

    a)         No owner, renter, lessee, or occupant of any premise or apartment within the city shall knowingly permit the unlawful consumption of alcoholic beverages by persons under the age of twenty-one (21) years upon the premises owned, rented, leased or occupied.  Premises shall be defined as the land and all buildings thereon.

    b)         It is prima facie evidence of a violation of the ordinance codified in this chapter if the owner, renter, lessee or occupant is present and one person under the age of twenty-one (21) years is present and is in possession of an alcoholic beverage.  It is prima facie evidence of a violation of the ordinance codified in this chapter if the owner, renter, lessee or occupant is present, and one person under the age of twenty-one (21) years is present and has consumed alcohol or is under the influence of alcohol, and an unsealed container of an alcoholic beverage is present.

    c)         Upon conviction under the ordinance codified in this chapter, the violator may be fined as provided in the general penalty section of the Code of the Town of the City of Buffalo.  Each person present under the age of twenty-one (21) years who is in possession of an alcoholic beverage or is under the influence of alcohol is a separate violation.

    d)         The ordinance codified in this chapter does not apply to parents or legal guardians who lawfully furnish alcohol to their children or legal wards when permitted by Wyoming law. 

    SECTION TWO:   This ordinance shall become effective upon its passage and publication in accordance with law.
